What are Argentina’s Laws on Kratom?

It’s a commonly accepted idea that most countries in South America tend to deal loosely with kratom, as in they don’t really ban the herb. Places like Peru, Ecuador, Bolivia, and Colombia don’t have any laws that control or outlaw kratom, although it’s also not a regulated industry within their borders either.

While it might be the trend among South American countries to take a relaxed approach to kratom legislation, Argentina is one of three exceptions. With strict laws that explicitly ban the herb, Argentina gives a fair warning to travelers hoping to visit with their stash in tow.

Is Kratom Legal in Argentina?

No – kratom is not legal in Argentina. Argentina explicitly banned or restricted kratom under governmental decrees (such as Decree 69/2017 and Decree 9/2017), making it a notable exception as one of the few South American countries to formally regulate and ban the herb.

Kratom (specifically its active chemical compound, mitragynine) is classified under the National Penal Code as a narcotic drug. The ban officially took effect in 2017 and illegalizes the use, sale, possession, and cultivation of kratom within their borders.

Since kratom is considered a narcotic, penalties for violations are governed by Argentina’s Drug Law No. 23.737, and depend entirely on the quantity you have and how authorities interpret your intent.

  • Possession for Personal Use – A case in 2009 resulted in the Arriola Ruling, in which the Supreme Court ruled that punishing someone for possessing small amounts of drugs for personal use is ‘unconstitutional.’ So this sets the precedent, even for visitors, who are caught with a small, personal amount of kratom in their possession. While this ruling will likely get any charges eventually dropped if you’re found with kratom while you’re in Argentina, that doesn’t mean you won’t first be apprehended, detained, and put through police processing.
  • Simple Possession – A slightly larger amount such as a few bags of loose powder or capsules may qualify as a simple possession violation if authorities can’t prove that the stash was either for personal use or commercial trade. This carries a prison sentence of between 1 to 6 years, depending on the amount of kratom you’re caught with.
  • Smuggling and Illegal Border Crossing – Because Argentina shares borders with numerous other countries, being caught with a large amount of kratom while traveling to Argentina and neighboring countries can raise suspicions about smuggling intent. This may lead to imprisonment between 4 to 15 years, and may result in other penalties including but not limited to fines, deportation, and travel bans.

Because of the prolific nature of smuggling and trafficking within South American territory, Argentinian authorities take the job of sniffing out illegal substances very seriously. They use a range of techniques including x-ray scanners, random inspections, drug-sniffing dogs, multi-panel testing, and various others so that no stone is left unturned.

So while some irresponsible users might suggest labeling your kratom as a supplement or tea, Argentina’s detection and identification process isn’t as easily bypassed.

Can You Buy Kratom Online in Argentina?

Since crossing the Argentinian border with kratom in tow could cause a lot of trouble, some people think that buying it online and having it shipped to an Argentinian address might be a safer workaround. But that’s not actually true.

Firstly, US-based kratom vendors won’t ship to Argentina. These companies take kratom laws very seriously and will explicitly omit countries from their roster of serviceable territories if they have laws that could get the brand in trouble.

Secondly, all packages that enter Argentina’s borders pass through strict customs assessments and processing, so even a discreetly packaged kratom bag will likely get flagged, intercepted, and confiscated.

Depending on the amount of kratom in the package, Argentinian authorities could enact a federal smuggling investigation for both recipient and sender. They’ve also been known to organize ‘controlled delivery’ which means they let the package pass through and complete the delivery process which they monitor to see where it ends up and who receives it.

Kratom Alternatives

If you’re planning a trip to Argentina and you need your kratom fix, it’s best to learn to settle for a few alternatives while you’re there. There are numerous options for kratom users who want to still experience relief and stimulation without kratom, which should come in handy for trips to countries like Argentina.

Some options include:

  • Caffeine – An effective nervous system stimulant, caffeine can be found in coffee, matcha, and black tea among others. A serving should suffice to wake you up and boost energy.
  • Stretching – Routine stretching can relieve physical aches and discomfort, allowing you to feel a little less stiff and sore.
  • Relaxation – Caffeine-free drinks such as peppermint tea and rooibos can make a relaxing addition to an evening routine. Their warmth, aroma, and lack of caffeine make them suitable alternatives to stimulating beverages.
  • Mood and emotional well-being – Lemon balm, lavender, chamomile, and saffron are herbs and botanicals traditionally associated with relaxation and emotional well-being.
  • Rest – Melatonin is a popular herbal supplement used to support nighttime routines, helping to induce a relaxed mood to achieve more effective, well-timed rest.
